1. Introduction

Welcome to OneTap. These Terms and Conditions govern your use of the OneTap mobile application and website (collectively, the "Service") operated by ALPHA5 TECHNOLOGIES (Pty) Ltd (Registration Number: 2025/552272/07), a company registered in the Republic of South Africa ("Company", "we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

2. Definitions

  • "User" refers to any individual who accesses or uses the Service.
  • "Vendor" refers to food and beverage providers who offer products through the Service.
  • "Venue" refers to event locations or permanent establishments where Vendors operate.
  • "Order" refers to a purchase request made by a User through the Service.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password secure and confidential.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

You must be at least 18 years old to create an account and use the Service.

4. Orders and Payments

4.1 Placing Orders

When you place an order through the Service, you are making an offer to purchase products from the relevant Vendor. All orders are subject to acceptance by the Vendor.

4.2 Pricing

All prices displayed on the Service are in South African Rand (ZAR) and include VAT where applicable. Prices are set by Vendors and may change without notice.

4.3 Service Fees

A service fee may be applied to orders processed through the Service. This fee will be clearly displayed before you confirm your order.

4.4 Payment Methods

Payments may be processed through our payment partner (Yoco) or paid at the counter, depending on the options available. By making a payment, you represent that you are authorized to use the chosen payment method.

5. Order Cancellation and Refunds

You may cancel an order while it is still in "pending" status. Once an order has been accepted by a Vendor, cancellation may not be possible.

6. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to any part of the Service.
  • Interfere with or disrupt the Service or servers.
  • Impersonate any person or entity.
  • Submit false or misleading information.
  • Use the Service to transmit harmful code or malware.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by ALPHA5 TECHNOLOGIES (Pty) Ltd and are protected by international copyright, trademark, and other intellectual property laws.

8. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the Service's reliability, availability, or fitness for a particular purpose.

We do not guarantee the quality, safety, or legality of products offered by Vendors. Vendors are independent third parties and are solely responsible for their products and services.

9. Limitation of Liability

To the maximum extent permitted by South African law, ALPHA5 TECHNOLOGIES (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

10. Indemnification

You agree to indemnify and hold harmless ALPHA5 TECHNOLOGIES (Pty) Ltd and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by posting the new Terms on the Service. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
